A shocking new court filing reveals the fallen WakeMed ER officer allegedly shot the suspect before the fatal ER shooting.
GARNER, N.C. – A shocking new twist has surfaced in the deadly WakeMed Garner emergency room shooting that claimed the life of a police officer last month.
According to newly filed court documents on behalf of the alleged suspect, the WakeMed Garner police officer who was killed in the hospital shooting is now accused of shooting the very man who is charged with his murder before the fatal incident unfolded.
Records filed Monday reveal that Officer Roger Smith allegedly shot Benji Martin Jr. on Nov. 8 inside the WakeMed Garner Healthplex.
Martin is currently being held in the medical unit at the Wake County Detention Center due to the severity of his injuries.
One court filing states that Martin remains hospitalized within the jail because he requires ongoing medical treatment and specialized supplies to properly care for his wounds and prevent complications.
Martin’s attorney, Emilia Beskind, has formally asked the court to step in, requesting that her client receive the proper medical supplies while in custody.
The motion specifically seeks access to correctly sized colostomy bags, sealing and tape materials, hygiene items such as soap, and other medically necessary ostomy supplies to meet basic standards of care.
The filing also claims that Martin entered the WakeMed Garner Healthplex that day seeking help and did not bring a firearm into the facility.
Last week, a small group of protesters gathered outside the Wake County Justice Center demanding transparency in the investigation. Their demonstration came shortly after a grand jury formally indicted Martin on a murder charge in connection with Officer Smith’s death.
Questions continue to swirl around what truly happened inside that emergency room.
